DMCA Policy
Blistered Tomatoes respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will respond promptly to claims of copyright infringement committed using the Blistered Tomatoes website or services if such claims are reported to our Designated Copyright Agent identified below.
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim to our Designated Copyright Agent using the instructions below.
Filing a DMCA Notice
To file a DMCA notice of infringing material on Blistered Tomatoes, please provide a written communication that includes substantially the following:
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
- A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
- Identification of the material that you claim is infringing and where it is located on the Blistered Tomatoes service, including the URL(s) where the material can be found.
- Your address, telephone number, and email address.
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Counter-Notification
If you believe that your material has been removed or disabled by mistake or misidentification, you may submit a written counter-notification to our Designated Copyright Agent. Under the DMCA, a counter-notification must include substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which Blistered Tomatoes may be found), and that you will accept service of process from the person who provided notification of the alleged infringement.
